Using a nationwide survey, this study compared the ethical values and decision processes ofFortune executives and MBA students. Statistically significant differences in ethical values were found by class of respondent, gender, and professed decision approach. MBAs were also found to process ethical decisions differently than business professionals.

The Supreme Court against the Criminal Jury critiques the Supreme Court’s decisions to allow reduced jury sizes and less than unanimous jury verdicts to determine guilt. John A. Murley and Sean D. Sutton challenges the Court’s decisions by examining its incomplete understanding of the purpose of trial by jury and evaluating its use of inaccurate and unreliable studies as support for its decisions.

In this paper, a new method of quantitatively assessing continuity and discontinuity of visual attention is developed. The method is based on representing narrative information using graph theory. It is applicable to any type of narrative report. Since dream reports are often described as bizarre, and since bizarreness is partially characterized by discontinuities in plot, we chose to test our method on a set of dream data. Using specific criteria for identifying and arranging objects of visual attention, dream narratives from (...) 10 subjects were obtained and mapped onto graphs. The interrater reliabilities were 76% and 91% . Discontinuities in visual attention were quantified by plotting transitions from one part of a graph to another, which provided a spatiotemporal map of attention shifts within a narrative. This procedure was compared with other approaches to discontinuity and also applied to a set of 10 fantasy reports from the same subjects. The results showed that our method includes but transcends other approaches and has the capability to distinguish dream and fantasy reports. To our knowledge, the method provides the most rigorous and reliable measure to date of continuity and discontinuity of attention in narrative reports. (shrink)

To test the notion that shifts in visual imagery and attention are correlated with experiences of emotion, we studied 10 dream reports using an affirmative probe of emotion and a quantitative measure of plot discontinuity. We found that emotion, especially changes in emotion, are correlated with discontinuities in visual imagery. These correlations are quantified using a new graph theoretical method for analyzing narrative reports.

This interview study investigates the short- and long-term implications of incidental findings detected through brain imaging on research participants’ lives and their surroundings. For this study, nine participants of the Rotterdam Scan Study with an incidental finding were approached and interviewed. When examining research participants’ narratives on the impact of the disclosure of incidental findings, the authors identified five sets of tensions with regard to motivations for and expectations of research participation, preferences regarding disclosure, short- and long-term impacts and impacts (...) on self and others. The paper shows: that the impact of incidental findings may be greater than participants at first let on; incidental findings can have significant effects on participants’ social environment; and participants may not feel prepared for disclosure even if incidental findings have been discussed during the informed consent process. The authors call for investigators to be aware of research participants’ experiences and these short- and long-term impacts when designing suitable courses of action for the detection and management of incidental findings in research settings. Background Levels of care deemed as inappropriate generate moral distress among nurses and other intensive care professionals. Inappropriate levels of care and related moral distress are frequently broached as individual and psychological phenomena, reduced to how individuals feel and think about specific cases. However, this tends to obscure the complex context in which these situations occur, and on which healthcare professionals can act. There is thus a need for a more contextual and team-level lens on inappropriate levels of care. Research (...) objective This study aims to explore and understand the issue of inappropriate levels of care in an intensive care unit (ICU) through a contextual and team-level lens. Research design Semi-structured interviews were conducted with nurses, respiratory therapists, and intensivists. Thematic analysis focused on understanding the causes and consequences of inappropriate levels of care, as well as potential avenues for improvement. This study is part of a 5-phase participatory living lab project on inappropriate levels of care conducted in the ICU of a Montreal (Quebec, Canada) hospital. This paper relates the initial phases of the project, focusing on understanding the issue, with reported events spanning from June 2022 to May 2023. Ethical considerations Ethics approval was sought and granted by the Research Ethics Board of the CIUSSS de l’Est-de-l’Île-de-Montréal. Findings/Discussion Five broad themes intrinsically related to the phenomenon of inappropriate levels of care were explored with and by participants: (1) the process of determining levels of care, (2) the distinction between appropriate and inappropriate levels of care, (3) causes of inappropriate levels of care, (4) consequences of inappropriate levels of care and (5) potential avenues for improvement. Social media offers a platform for diffused stakeholders to interact with firms—alternatively praising, questioning, and chastising businesses for their CSR performance and seeking to engage in two-way dialogue. In 2014, 163,402 public messages were sent to Fortune 200 firms’ CSR-focused Twitter accounts, each of which was either shared, replied to, “liked,” or ignored by the targeted firm. This paper examines firm reactions to these messages, building a model of firm response to stakeholders that combines the notions of CSR communication and (...) stakeholder salience. Our findings show that firm response to a stakeholder on social media is positively and most significantly associated with what we refer to as the stakeholder’s connective power but negatively associated with the firm’s own connective power. To a lesser extent, firm response is positively associated with the stakeholder’s normative power but negatively associated with the firm’s own normative power. Firm response is also shown to be positively associated with stakeholder urgency in terms of both the originality of a stakeholder message and the expression of positive sentiment. (shrink)

Coral bleaching has impacted reefs worldwide and the predictions of near‐annual bleaching from over two decades ago have now been realized. While technology currently provides the means to predict large‐scale bleaching, predicting reef‐scale and within‐reef patterns in real‐time for all reef users is limited. In 2020, heat stress across the Great Barrier Reef underpinned the region's third bleaching event in 5 years. Here we review the heterogeneous emergence of bleaching across Heron Island reef habitats and discuss the oceanographic drivers that (...) underpinned variable bleaching emergence. We do so as a case study to highlight how reef end‐user groups who engage with coral reefs in different ways require targeted guidance for how, and when, to alter their use of coral reefs in response to bleaching events. Our case study of coral bleaching emergence demonstrates how within‐reef scale nowcasting of coral bleaching could aid the development of accessible and equitable bleaching response strategies on coral reefs. If we are to ensure the persistence of species in an increasingly warm world, of interest is the identification of drivers that affect the ability of an organism to resist thermal stress. Underpinning any organism's capacity for resistance is a complex interplay between biological and physical factors occurring over multiple scales. Tropical coral reefs are a unique system, in that their function is dependent upon the maintenance of a coral–algal symbiosis that is directly disrupted by increases in water temperature. A (...) number of physical factors have been identified as affecting the biological responses of the coral organism under broadscale thermal anomalies. One such factor is water flow, which is capable of modulating both organismal metabolic functioning and thermal environments. Understanding the physiological and hydrodynamic drivers of organism response to thermal stress improves predictive capabilities and informs targeted management responses, thereby increasing the resilience of reefs into the future. Background Implementing person-centred care (PCC) in nursing homes is challenging due to a gap between theory and practice. Bridging this gap requires suitable education, which focuses on learning how to attune care to the values and preferences of residents and take moral, relational, and situational aspects into account. Staff’s stories about the care they provide (i.e. caring stories) may deliver valuable insights for learning about these aspects. However, there is limited research on using staff's narratives for moral learning. Objective This (...) study aims to provide insight into the perspectives of nursing staff on using their caring stories to learn about PCC. Research design In this qualitative research, we conducted two rounds of interviews with 17 participants working in nursing homes. We wanted to obtain nursing staff’s perceptions of working with their caring stories and the impact on PCC. Ethical considerations Participation was voluntary, and participants provided written consent. The study protocol is approved by The Institutional Review Board of the Medical Ethical Committee Leiden-Den Haag-Delft. Findings Working with caring stories enables nursing staff to provide PCC and improves job satisfaction. It increases awareness of what matters to residents, fosters information rich in context and meaning, and enhances voice and vocabulary. Through in-depth team reflections, nursing staff discussed the significant moments for residents, which centralizes the discussions on the moral quality of care. Discussion Working with caring stories fosters dialogue on PCC and enhances reflection on ethical situations in daily encounters, contributing to the moral development of nursing staff. Putting nursing staff’s narratives at the centre of learning suits their daily practice and intrinsic motivation. Therefore, the outcomes of this study are an addition to the existing literature about using narratives in long-term care. Conclusion Using nursing staff's narratives contributes to PCC and positively impacts nursing staff. We recommend using staff's caring stories as a vehicle for moral learning in the transition to PCC. (shrink)

For us, narrative care is grounded in pragmatist philosophy and focused on experience. Narrative care is not merely about acknowledging or listening to people's experiences, but draws attention to practical consequences. We conceptualize care itself as an intrinsically narrative endeavour. In this article, we build on Lugones' understanding of playfulness, particularly to her call to remain attentive to a sense of uncertainty, and an openness to surprise. Playfulness cultivates a generative sense of curiosity that relies on a close attentiveness not (...) only to the other, but to who we each are within relational spaces. Generative curiosity is only possible if we remain playful as we engage and think with experiences and if we remain responsive to the other. Through playfulness, we resist dominant narratives and hold open relational spaces that create opportunities of retelling and reliving our experiences. Drawing on our work alongside older adults, as well as people who work in long‐term care, we show the possibilities of playfulness in the co‐composition of stories across time. By intentionally integrating playfulness, narrative care can be seen as an intervention, as well as a human activity, across diverse social contexts, places and times. (shrink)

On en souligne l’efficacité polémique dans la controverse opposant les Stoïciens aux Épicuriens sur la fin (telos) naturelle ainsi que la portée théorique dans l’explication du développement moral et social de l’homme. Outre les difficultés rencontrées pour cerner les contours et la consistance théoriques de l’appropriation, son statut est également fortement débattu : s’agit-il d’une invention stoïcienne ou bien en trouve-t-on l’équivalent ou les linéaments dans la philosophie péripatéticienne ? Des droits fondamentaux au fondement du droit, le lien semble non seulement direct, mais évident. Or l'examen des différents discours théoriques sur le droit montre qu'il n'en est rien. Le livre de Charlotte Girard analyse précisément les différences de traitement du rapport entre ces deux termes dans les discours théoriques juridiques, en particulier ceux qui posent la question du fondement du droit. Soit l'étude des droits fondamentaux se distingue de celle du fondement du droit - les droits fondamentaux ne (...) mènent pas naturellement au fondement du droit -, soit on associe les deux notions - les droits fondamentaux sont au fondement même du droit. Or cette distinction renvoie à ce que la théorie du droit différencie traditionnellement : les approches juspositiviste d'une part et jusnaturaliste d'autre part. La confrontation de ces discours théoriques à la question du fondement du droit, qu'elle se traduise ou non par les droits fondamentaux, révèle une certaine fragilité des présupposés respectifs de ces discours. En réalité, le fondement du droit n'est pas seulement un élément de débat juridique et normatif, mais il relève aussi et surtout d'un débat politique et institutionnel. C'est en effet en raison de son caractère normatif que le fondement du droit - quel que soit le discours qui le porte, y compris le discours juridique théorique - appartient pleinement au champ politique. Background Ensuring individual free and informed decision‐making for research participation is challenging. It is thought that preliminarily informing communities through ‘community sensitization’ procedures may improve individual decision‐making. This study set out to assess the relevance of community sensitization for individual decision‐making in research participation in rural Gambia. Methods This anthropological mixed‐methods study triangulated qualitative methods and quantitative survey methods in the context of an observational study and a clinical trial on malaria carried out by the Medical Research Council Unit Gambia. Results/discussion Although 38.7% of the respondents were present during sensitization sessions, 91.1% of the respondents were inclined to participate in the trial when surveyed after the sensitization and prior to the informed consent process. This difference can be explained by the informal transmission of information within the community after the community sensitization, expectations such as the benefits of participation based on previous research experiences, and the positive reputation of the research institute. Commonly mentioned barriers to participation were blood sampling and the potential disapproval of the household head. Conclusion Community sensitization is effective in providing first‐hand, reliable information to communities as the information is cascaded to those who could not attend the sessions. However, further research is needed to assess how the informal spread of information further shapes people's expectations, how the process engages with existing social relations and hierarchies (e.g. local political power structures; permissions of heads of households) and how this influences or changes individual consent. Conçue à l'origine comme une épistémologie du savoir sensible, l'esthétique a connu trois siècles d'évolution pour devenir une philosophie de l'art. Cette réunion d'études croisées évalue la présence de la logique dans le champs esthétique, et l'évolution de leur relation dans l'histoire de la pensée.

La crise écologique planétaire a des racines philosophiques fortes : elle questionne nos habitudes, notre modèle de société, mais également notre système de croyances et nos représentations du monde. Comprendre les enjeux profonds de cette crise nous plonge dans l'histoire de nos représentations de la nature et de l'humain. À l'attentisme ambiant, l'auteure oppose l'élaboration collective d'un nouveau sol écophilosophique qui serve d'humus pour l'émergence d'une civilisation "soutenable".

Randomised placebo-controlled trials (RPCTs) are the gold standard for evaluating novel treatments. However, this design is rarely used in the context of orthopaedic interventions where participants are assigned to a real or placebo surgery. The present study examines attitudes towards RPCTs for orthopaedic surgery among 687 orthopaedic surgeons across the USA. When presented with a vignette describing an RPCT for orthopaedic surgery, 52.3% of participants viewed it as ‘completely’ or ‘mostly’ unethical. Participants were also asked to rank-order the value of (...) five different types of evidence supporting the efficacy of a surgery, ranging from RPCT to an anecdotal report. Responses regarding RPCTs were polarised with 26.4% viewing it as theleastvaluable (even less valuable than an anecdote) and 35.7.% viewing it as themostvaluable. Where equipoise exists, if we want to subject orthopaedic surgeries to the highest standard of evidence (RPCTs) before they are implemented in clinical practice, it will be necessary to educate physicians on the value and ethics of placebo surgery control conditions. Otherwise, invasive procedures may be performed without any benefits beyond possible placebo effects. (shrink)

Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Dans un contexte d'enchevêtrement des systèmes normatifs et de pluralisme juridictionnel, la question de l'autorité de la jurisprudence est centrale. Tantôt abordée comme un instrument normatif, tantôt comme une donnée purement factuelle, elle est toujours une variable inconstante. Entre la thèse de "l'autorité de la chose interprétée" et le concept de "dialogue des juges", il est difficile de parvenir à une conception unanime de l'influence que produit la jurisprudence. La thèse défendue systématise cet effet en limitant l'analyse à ce que (...) prescrivent les énoncés normatifs en vigueur. Partant du principe de déterminisme textuel, les juridictions sont prioritairement contraintes par les énoncés dispositionnels dont elles doivent faire application. Une part d'indétermination résulte néanmoins des spécificités de chaque contentieux, attachées aux questions litigieuses dont les juridictions sont saisies. La systématisation de l'effet que produit la jurisprudence repose sur deux critères essentiels : les normes et leurs modalités d'application. Sur ces fondements, la thèse propose de démontrer que la jurisprudence a valeur de preuve. La présence des deux critères susmentionnés conditionne les relations que les juridictions entretiennent. La jurisprudence produit ainsi un effet corroboratif. Ce dernier désigne le processus factuel par lequel l'interprétation délivrée par une juridiction est utilisée à des fins probatoires par une autre juridiction, en raison de l'analogie qu'elle établit. Le critère de l'analogie, entendu comme la "ressemblance de rapports" normatifs et factuels existant entre deux ou plusieurs litiges, constitue le lien essentiel à la réalisation des relations jurisprudentielles. L'étude s'attache à illustrer ce processus dans les rapports d'influence interprétative qu'entretiennent cinq juridictions : la Cour de justice, la Cour européenne des droits de l'homme, le Conseil constitutionnel français, la Cour de cassation et le Conseil d'Etat. L'effet corroboratif de la jurisprudence fournit une grille de lecture des relations jurisprudentielles, excluant toutes considérations extra-juridiques. (shrink)

En considérant qu’un dispositif est une auto-organisation régulatrice, nous proposons de discuter les modalités d’une alternance intégrative que nous avons expérimentée en formation d’adultes. La régulation est abordée sous l’angle de l’évaluation progressive de la formation et de ses finalités émancipatrices travaillées dans un accompagnement multiforme à l’autoformation. La place de la réflexivité étant centrale, nous centrons notre propos ici sur la lecture critique d’un outil que nous avons développé, l’Indice de Vécu en Formation (IVF) afin de recueillir les représentations (...) des alternants sur la manière dont ils vivent la formation et de leur proposer un accompagnement adapté. Cet article examine la doctrine des catégories développée par Emil Lask (1875-1915) au début du xx e siècle (1911). Son objectif est double. 1) Nous entendons proposer une étude historique précise de cette doctrine relativement méconnue qui présente une synthèse inédite entre l’objectivisme sémantique de Bolzano, la théorie des valeurs de l’école de Bade et le formalisme husserlien, dans le contexte de l’héritage de la révolution copernicienne kantienne. Nous montrons que cette doctrine présente un caractère radical en ceci qu’elle considère (...) que la philosophie est eo ipso une doctrine des catégories. 2) Le deuxième objectif de cette étude, plus critique, est d’évaluer la pertinence de la lecture herméneutique, d’inspiration heideggérienne, qui en est souvent proposée. S’il est indéniable que la doctrine de Lask exerça une réelle influence sur la phénoménologie herméneutique du jeune Heidegger, nous entendons également montrer que les intuitions originales de Lask sur la résistance du matériau sont irréconciliables avec toute forme d’herméneutique.
